1. Definitions

LIFE CHANGES TODAY, LLC (LCT) and the associated domain, Life-Changes-Today.com, “LCT” referred to throughout in the second person as “us”, “we”, “our”, etc. is an online integrated system to support fundraising efforts targeted for school-related boosters specific to sports and extra-curricular activities as well as fundraising efforts to support Fraternities & Sororities (and their respective philanthropic causes) on college campuses.  LCT is not limited to the aforementioned as other entities can and will take advantage of the opportunities provided by LCT.  LCT is an Independent Business Owner (IBO) of Total Life Changes, LLC (TLC) and has chosen to promote the products of TLC to create an automated, streamlined solution to provide an innovative solution to meet organizations’ fundraising needs.

 

The LCT service offering (collectively, the “Service”) includes www.Life-Changes-Today.com (“Site”); and any services available on or through the website or otherwise provided by LCT or any applications (including mobile applications) made available by LCT.  Any party that accesses or uses any Service, whether manually or through automated means, is defined as a “User”, and applies to all - whether a member of a participating Organization, a member of a prospecting Organization, a Customer supporting a participating Organization, a representative of LCT or any other party that accesses or uses any LCT Service, whether manually or through automation provided by LCT, is defined as a “Customer”.  All “Customer(s)” are “User(s)”.  "Policies" means the various policies, guidelines, and other terms and conditions that are referenced herein, but are not expressly set forth in this Privacy & Security Policy. The Policies may be updated from time to time by LCT.

 

2. Overview

 

This Privacy & Security Policy is the exclusive and authoritative source of our privacy and security practices.  Please keep in mind that this Privacy Policy does not apply to other websites, which may be accessible from the Website. External websites may have data collection, storage, and use practices and policies that differ materially from those contained herein and in such cases are governed by the Privacy policies and Security policies defined within their Website.

 

We may update this Privacy Policy from time to time. If we do so, we will notify you by posting the date of the last change or amendment at the top of this page.  It is set forth and agreed that this method of notice is sufficient and that you will regularly check this Privacy Policy to see if updates or changes have been made.

4. Data Collection

 

Life-Changes-Today.com automatically collects certain information when a User visits our Website. Traffic Data is anonymous information that does not personally identify you but is helpful for us to improve the business performance and user experience of the Website.  Cookies and other web-related tools are used to collect Traffic Data related to the Website. This is non-personally identifiable information compiled to allow Life-Changes-Today.com to aggregate statistical information about usage of the Website and helps us improve our communication and marketing efforts.

Personal Information.  In order for a User to register through the Website or take certain other actions on the Website (e.g. contacting us through forms, etc.), information that personally identifies a Customer is required ("Personal Information"). Personal Information includes contact data such as name, mailing address, e-mail address and/or phone numbers and certain activity data.

 

Use of Personal Information.  Some of the ways Personal Information is used include: sending confirmations, sending updates about the Website, sending updates about activity on the Website related to you and the participating Organization for which you are associated, sending newsletters, responding to customer service inquiries, sending marketing materials, surveys or inquiries to improve our marketing efforts.

 

5. Security

 

LCT Confidentiality.  Except as otherwise provided in this Privacy & Security Policy, Personal Information will not be shared with other third parties unless such disclosure is necessary to: (i) comply with a court order or other legal process, (ii) to protect our rights or property, or (iii) to enforce our Terms of Service. Please keep in mind that while LCT takes reasonable precautions to safeguard your Personal Information, no amount of protection can 100% guarantee its security.

 

Access to Personal Information.  Third Party business partners performing core services (such as hosting, data storage, and security) related to the operation of the Website do have access to other Personal Information, but only in encrypted form. This is required to perform these core services, which are necessary for the orderly operation of the Website. Customer consents to the foregoing and agrees that LCT is not responsible for how these organizations or persons handles Personal Information. Customer may contact them directly for their privacy policies and data usage practices.

Payment Processing.  No financial transactions of Customer(s) purchases of TLC products associated with the integrated fundraising program of LCT will be processed in the domain Life-Changes-Today.com.   All financial transactions for TLC products will be processed through TLC’s web site (independent from LCT) for which TLC’s Terms of Use, Privacy Policy, Income Disclaimer and Refund Policies will govern all cash management and supply chain management for all purchased products.

 

6. User Data and Privacy Statement

 

User Responsibility. User shall be solely responsible for the quality and accuracy of all data that is entered into the Site. Except as otherwise provided herein, such data shall be your sole property. We respect and honor the confidentiality of User data, including Customer information and member data, etc. Accordingly, LCT will exercise reasonable care to (a) keep all data pertaining to you and stored in the Site private and (b) not disclose such data to anyone except employees, agents, and contractors of LCT who need to know the same in order to facilitate the performance of their duties to provide Service(s).

 

LCT is the sole owners of the Personal Information collected on this site. We only have access to/collect information that the User voluntarily provided via email or other direct contact from you via the LCT automated system for which Service(s) are provided. LCT will not sell or rent this information to anyone.  Unless otherwise requested by User, we may contact you in the future to provide Service(s), or to notify User of changes to this privacy policy.  LCT will exercise reasonable care in the protection of User data and will maintain reasonable data integrity safeguards against the deletion or alteration of User data. If any data is lost or destroyed because of any act or omission of LCT or any noncompliance with LCT’s obligations defined herein, then LCT will at its own expense, use commercially reasonable efforts to reconstruct such data as soon as possible. LCT will store and safeguard storage media containing User data when in the custody of LCT. User acknowledges and accepts that the Service will be unavailable when LCT is backing up data or undergoing regular system maintenance.
 

Confidentiality. User will hold confidential and will not use any Customer information obtained through the Service, except for uses expressly permitted by the Federal and State laws. User will not disclose or cause to be disclosed any LCT Confidential Information without LCT's prior written consent.  User agrees that User is responsible for any act in breach of this paragraph. User agrees to use the same degree of care, but no less than a reasonable degree of care, as User uses with respect to its own information of a similar nature to protect the LCT Confidential Information and to prevent communication of LCT Confidential Information to any unauthorized third parties. "LCT Confidential Information" includes without limitation: (a) all LCT software, intellectual property, technology, programming, specifications, materials, guidelines and documentation relating to the Service; (b) any information provided pursuant to this Privacy & Security Policy, including, without limitation, tangible, intangible, visual, electronic, present, or future information such as: (i) trade secrets; (ii) intellectual property; (iii) financial information, including fundraising algorithms; (iv) technical information, including research, development, procedures, algorithms, data, designs, and know-how; and (v) business information, including operations, planning, marketing and promotion plans; and (c) any other information designated in writing by LCT as "Confidential" or an equivalent designation. This Privacy & Security Policy imposes no obligation upon User with respect to LCT Confidential Information that: (a) was known to User before receipt from LCT; b) is or becomes publicly available through no fault of User; (c) is rightfully received by User from a third party without a duty of confidentiality; or (d) is independently developed by User without a breach of this Privacy & Security Policy. If LCT Confidential Information is required to be produced by law, court order, or other governmental demand ("Process"), User must immediately notify LCT of that obligation. User will not produce or disclose LCT Confidential Information in response to the Process unless LCT has requested protection from the court or other legal or governmental authority requiring the Process and the request has been denied. Upon LCT’s written request, User will promptly return all LCT Confidential Information, together with all copies, or certify in writing that all LCT Confidential Information and copies have been destroyed.

 

Usernames and Passwords. User will be responsible for maintaining the confidentiality of its Service usernames and passwords as applicable to certain Users. User is responsible for all Service activity by persons that use the usernames and passwords, including any consequences of the use or misuse of the usernames and passwords. User agrees to notify LCT immediately of any unauthorized use of its usernames and passwords or any other breach of security regarding the Service of which User has knowledge. User agrees that all officers, employees, agents, representatives and others having access to the Service usernames and passwords will be vested by User with the authority to use the Service and legally bind User.

 

7. Customer Privacy Policy

 

When a Customer registers in support of a participating Organization through the Site, Customer grants us, as an Independent Business Owner (IBO) of TLC, permission to access Customer’s sales transactions from TLC via an automated upload originating from TLC’s site to process the data to calculate fundraising contributions for the respective participating Organization.  If you are an authorized representative of a participating Organization, Customer information will be shared with you via report(s) furnished by LCT and sent with the disbursement of funds raised in accordance to the Terms and Conditions of the executed Fundraising Representation Agreement.
